CLAIMS
I represent individuals that have
been injured by another’s negligence. Damage may include broken
bones, damage to reputation, or property resulting from a Motor
Vehicle Accident, Large Truck Accident, Bus Accident, Passenger Van,
Motorcycle Accident, Boating Accident, Aviation Accident, Swimming
Accident, Train Accident, Wrongful Death, Slip and Fall, Unsafe
Premises and Defamation.
Motor Vehicle Accidents. According to the U.S. Department of
Transportation's National Highway Traffic Safety Administration,
more than 42,800 people were killed in motor vehicle accidents and
almost 3,000,000 people were injured in Motor Vehicle Accidents in
2002. More than 6,000,000 accidents occurred in 2002. These
accidents were often caused by drunk drivers, fatigue and reckless
behavior on the part of other drivers. If one of these drivers has

Pedestrians and Bicyclist. More than 4,800 Pedestrians are
killed each year by motorists. On the average, every two hours a
pedestrian is killed. There are more than 71,000 pedestrians injured
every year by motor vehicles. Tragically, many of the victims are
children that have been backed over by cars leaving driveways.
The first automobile crash in the United States occurred in New York
City in 1896, when a motor vehicle collided with a pedalcycle rider.
In 2002, 662 pedalcyclists were killed and an additional 48,000 were
injured in traffic crashes. Pedalcyclist deaths accounted for 2
percent of all traffic fatalities, and pedalcyclists made up 2
percent of all the people injured in traffic crashes during the

Truck Accidents. Large trucks are those vehicles that have a
gross vehicle weight rating of greater than 10,000. In 2002 large
trucks were involved in accidents that caused 4,183 people their
lives. Truck tractors pulling semi-trailers accounted for 63% of
those trucks involved in those fatal crashes.
Many people are injured by large trucks each year. In 2002 alone
48,955 large trucks were involved in injury crashes and more than
130,000 people were injured in those accidents. One cause of these
accidents, truck driver fatigue, has been estimated to have caused
more than $2.3 billion dollars in damage. From 1997-1999 the average

Bus Accidents. There are more than 670,000 Commercial Buses
registered in the United States. In the decade between 1991 and
2001, an average of 26 children died each year in school bus
accident, 19 as pedestrians - getting on or off a school bus - and
seven as passengers. More than 19,000 people are injured every year

Passenger Vans. According to government statistics, over 440
persons have been killed and hundreds injured in rollover crashes
involving the large, heavy vans since 1990.
National Highway Transportation Safety Administration research has
shown that 15-passenger vans have a rollover risk that increases
dramatically as the number of occupants increases from fewer than
five to more than ten. In fact, 15-passenger vans (with 10 or more
occupants) had a rollover rate in single vehicle crashes that is
nearly three times the rate of those that were lightly loaded.
Over the past decade, 80 percent of people killed in rollover
crashes in 15-passenger vans were unbelted. Passengers can
dramatically reduce their risk of being killed or seriously injured
in a rollover crash by simply using their seat belts. Organizations
that own 15-passenger vans should have a written seat belt use
policy. Drivers should be responsible for enforcing the policy.

Motorcycle Accidents. More than 120,000 motorcyclists have
died in traffic crashes since the enactment of the Highway Safety
and National Traffic and Motor Vehicle Safety Act of 1966.
Motorcyclists were about 26 times as likely as passenger car
occupants to die in a motor vehicle traffic crash and 5 times as
likely to be injured. In 2002 alone, more than 3,200 people were
killed in motorcycle accidents. About one-half of the motorcycles
involved in fatal crashes in 2002 involved collisions with other
motor vehicles. There were more than 65,000 people injured in

Boating Accident. There are more than 5,705 boating accidents
every year. In 2002 there were more than 750 fatalities, and 4,062
injuries. Property damage exceeded $39,000,000. Many of these
accidents were caused by the negligence of the operator. Operator
inattention, carelessness/reckless operation, operator inexperience,
and excessive speed are the leading contributing factors of all

You can decrease your risk of injury or death by wearing a life
preserver. Seventy percent of all fatal boating accident victims
drowned (524 out of 750). Nearly 85% of the victims who drowned were
not wearing their personal flotation device (PFD or lifejacket).
Overall, fatal accident data show approximately 440 lives could have
been saved last year if boaters had worn their lifejackets.
Aviation Accident. Aviation law concerns many
aircraft-related incidents and accidents, including: violations of
FAA regulations; accidents caused by aviation equipment, structural
or design problems with planes; pilot error. The number of aviation
accidents varies each year. More than 1,800 aviation accidents
occurred in the 2003 causing almost 700 people to lose their lives.
If the airline, it pilots and crew, the aircraft manufacturer or
other responsible parties acted negligently, recklessly, or with
intentional disregard for your safety you may have a case.
Swimming Accident. Many swimming injuries are caused by a
lack of a propeller guard on boats. The term "propeller guard" is a
widely misused term since there are basically four different types
of propeller guards available today, as well as several alternatives
to propellers. These guards could prevent many injuries that people
suffer. You may be able to obtain compensation for your injuries
from the manufacturer who fails and refuses to provide a guard.
Train Accident. Each year freight trains and cars collide
more than 4,000 times, resulting in more than 400 deaths. Overall,
more than 950 people are killed each year in accidents with trains.

Wrongful Death. A wrongful death action is a lawsuit brought
by the family of the person killed. The family may recover damages
from any person who, through negligence or direct act or omission,
caused the death of certain relatives (eg. spouse, child or parent).
Slip and Fall. Slip and fall" is a term used when a person is
injured because an unsafe condition caused them to slip, trip and/or
fall. It includes falls as a result of water, ice or snow, as well
as abrupt changes in flooring, poorly lit walk spaces, and hazards
such as unsafe stairs, a gap or a obscured hole in the ground.
Unsafe Premises. In the District of Columbia landowners are
required to take reasonable care under all circumstances to keep
their land safe. When an individual suffers an injury on the
property, or "premises" owned or maintained by someone else and the
injuries were the result of a dangerous condition that existed on
the property, the property owner may be held legally responsible.
Some injured people have recovered when there has been inadequate
security in apartment buildings, hotels and at ATMs.
Defamation. A person bringing a defamation action must show
that another person made a false and defamatory statement concerning
them, the statement was published without privilege to a third
party, that the person’s fault in publishing the statement amounted
to at least negligence; and either that the statement was actionable
as a matter of law irrespective of special harm or that its
publication caused the plaintiff special harm.
Business Disparagement and False Light are claims that often arise
simultaneously with Defamation. Many doctors and dentists are forced
to file suit when a person makes a false and defamatory statement
about them and/or their business. To prove a business disparagement
claim you must show another person published a disparaging statement
concerning your business. The statement must have been false when
made. The person making the statement must have intended that the
publication cause pecuniary loss or reasonably should have
recognized that publication would result in pecuniary loss. The
statement must have caused actual pecuniary loss.
